Acceptance

These terms set out how you may use this website, which Affinity Search Partners operates from 5123 Virginia Way, Suite A23, Brentwood, TN 37027. Opening, reading or otherwise making use of the site counts as acceptance of them. Anyone who does not accept them should leave the site.

The privacy notice, which describes our handling of information about people, is part of these terms and sits at /notices/privacy.

Purpose of the site

The site introduces the recruiting services we offer: placing technical staff and technology leaders on a contract, contract-to-hire or permanent basis, and helping employers decide the sequence in which a team gets built. Its job is to describe the firm and its way of working.

No part of the site constitutes an offer of services, a quotation or a commitment. Engagements between us and a client are governed solely by a written contract that both parties have signed, and where the site and such a contract disagree, the contract prevails.

Outreach email

We may send business email to people whose work touches on hiring for technical roles, at the addresses they use in their jobs. Any recipient can end further messages by replying with a request to stop, in whatever words they choose. Our privacy notice covers the collection and use of contact details, what happens after a stop request, and the choices open to you.

Sample material

The site shows a drawn team plan board and may show other boards, charts, checklists, role lists and figures, whether on the page or in material we link to. Every one of them is an invented illustration. None reports the outcome of a client engagement, describes a real team or company, or offers any forecast or assurance of what a search will produce for you.

Conduct

Use of the site must stay within the law. Beyond that, you agree not to:

• disrupt the site or the servers and networks that deliver it, or attempt to overload them;
• try to reach areas of the site, its hosting or related systems that are not deliberately public;
• probe, scan or test the site for weaknesses without our written consent;
• run automated tools, scripts or scrapers to copy, harvest or index its content.

Ownership

The site and all of its content, including the text, the layout, the logo, the sample board and the code that draws it, belongs to us or to those who license it to us. You are welcome to read the pages and print them for reference inside your own business. Anything beyond that, such as reproducing, distributing or reusing content, requires our written consent.

Rights in work we perform for a client, including candidate profiles, shortlists and reports, are fixed by the written contract covering that work, not by these terms.

Outside links and services

This site points to our primary website at affinitysearchpartners.com and to the contact form there, and its typeface arrives from a font host that another company operates. We do not control those sites or services, and your use of them is subject to the conditions and privacy rules of whoever runs them. A link from here does not mean we endorse what is found at the far end.

Disclaimer

The site is supplied "as is", and likewise "as available", in whatever state it happens to be in. So far as the law permits, we make no warranty of any kind about it, whether stated or implied, and we specifically disclaim implied warranties of merchantable quality, suitability for a given purpose, accuracy and non-infringement. We give no assurance of uninterrupted availability, freedom from errors or freedom from harmful components.

What the site contains is general information about our firm and our field. It is not professional counsel, and not guidance on legal, financial or hiring questions, and nobody should rely on it as though it were.

Liability

So far as the law permits, Affinity Search Partners accepts no liability to you for damages of an indirect, incidental or special kind, for consequential loss or for punitive awards, and none for profits, revenue, data or opportunities that are lost, arising from or connected with the site or these terms, however the claim is framed and even where we were warned such loss might occur.

Our aggregate liability for every claim connected with the site or these terms is capped at one hundred US dollars in total. Where a jurisdiction restricts limits of this kind, they apply only so far as it allows.

Indemnity

Where misuse of the site on your part, or a breach of these terms, causes a claim, loss or expense for Affinity Search Partners, you agree to defend and indemnify us and to hold us harmless, covering reasonable attorneys' fees and costs among the rest.

Law and arbitration

Tennessee law governs these terms and every dispute connected with the site, meaning the State of Tennessee supplies the governing law and its conflict rules are set aside. A dispute we cannot settle by talking will be resolved through binding arbitration seated in Williamson County, Tennessee, conducted under American Arbitration Association rules, and the award may be entered as a judgment in a court with the power to enforce it. This arbitration requirement falls away if applicable law forbids it, and either side may take a qualifying matter to small claims court instead.

Remaining provisions

• Should a court find a provision unenforceable, the remainder stays in force with the smallest change needed.
• Our failure to insist on a term at one time does not stop us insisting on it later, and no waiver counts unless written.
• These terms and the privacy notice together form the complete understanding between you and us regarding this site, superseding anything earlier on the subject.
• We may revise these terms whenever we choose. A revised version applies once posted here with a fresh effective date beneath the title.
